IMPORTANT TERMS AT A GLANCE
Please read this section before placing your order. Most PremiumCards products are custom manufactured specifically for you. The following summarizes several of the most important terms of your purchase.
This summary is provided for convenience and does not replace the complete Terms and Conditions below. The complete Terms govern your order. Nothing in this summary or the complete Terms limits any right that cannot legally be waived under applicable law.
CUSTOM PRODUCTS — ALL SALES GENERALLY FINAL
Most of our products are custom printed or manufactured specifically for your order and have no practical resale value.
Once production has begun, custom orders generally cannot be canceled, returned, or refunded because you changed your mind, ordered the wrong product or quantity, supplied incorrect artwork, or no longer need the order.
If PremiumCards makes a qualifying manufacturing error, we will provide the appropriate remedy as described in the full Terms.
CHECK YOUR PROOF CAREFULLY
If your order includes a proof, you are responsible for reviewing and approving it before production.
Approval means you accept the visible:
- spelling and text;
- artwork and images;
- orientation;
- layout and placement;
- dimensions; and
- foil, Spot UV, or other finishing locations shown on the proof.
Customer-approved errors are not manufacturing defects.
If we produce something materially different from the approved proof, that is a different matter and will be reviewed as a possible PremiumCards production error.
PROOFS MUST BE ANSWERED WITHIN 7 DAYS
Proofs are sent to the email address associated with your order.
You have 7 calendar days to approve the proof or request corrections.
If we receive no response after 7 days, you authorize PremiumCards to release the most recent proof for production as described in the complete Terms.
Please check your spam or junk folder if you are expecting a proof.
TURNAROUND TIMES ARE ESTIMATES
Production times shown on our website or provided in ordinary estimates are estimated production times and are not guaranteed delivery dates unless PremiumCards expressly agrees to a guaranteed date in writing.
Production time normally begins after we have:
- received usable artwork;
- received required information;
- received required payment; and
- received proof approval or authorized proof release.
Shipping/transit time is additional to production time.
Rush service expedites an order but does not automatically guarantee an in-hand delivery date.
COLOR WILL NOT EXACTLY MATCH YOUR SCREEN
Computer monitors, phones, tablets, electronic proofs, paper stocks, coatings, lamination, foil, and printing processes can all affect color.
Screen colors are not considered an exact representation of printed color.
Standard printing does not include guaranteed Pantone or exact color matching unless specifically quoted as such.
Colors may also vary between separate print runs.
CUTTING AND CENTERING HAVE NORMAL TOLERANCES
Printing and finishing are mechanical manufacturing processes.
Trimming, centering, printing, die cutting, foil stamping, Spot UV, folding, duplexing, rounded corners, and similar processes can move slightly during production.
Unless a different tolerance is specifically stated for a product, normal production movement may be approximately:
±1/16 inch (approximately 1.6 mm).
Designs with thin or perfectly symmetrical borders can make normal movement much more noticeable.
If exact border consistency is important, contact us before ordering so we can discuss die cutting or another production method.
ROUNDED CORNERS ARE NOT PERFECTLY IDENTICAL
Standard rounded corners are applied mechanically and may vary slightly from card to card.
For projects requiring substantially greater corner and cutting consistency, custom die cutting should be requested before production.
SPECIALTY FINISHES MAY HAVE REGISTRATION VARIATION
Foil stamping, holographic foil, Spot UV, raised effects, edge painting, embossing, duplexing, die cutting, and other specialty finishing processes can have normal registration and material variation.
If we warn you that a design or finishing choice is outside our recommended specifications and you instruct us to proceed anyway, you accept the disclosed production risk to the extent permitted by law.
QUANTITIES MAY VARY SLIGHTLY
Unless your quote specifically guarantees an exact finished quantity, commercial printing may result in an over-run or under-run of up to 7%.
If the finished quantity is below the quantity purchased, PremiumCards will provide a proportional credit or refund for the shortage unless another arrangement was specifically agreed to.
REPORT PRODUCTION PROBLEMS PROMPTLY
Please inspect your order when it arrives.
Manufacturing defects, shortages, incorrect products, or shipping damage should be reported to PremiumCards within 10 calendar days after delivery whenever reasonably possible.
We may require photographs and may require some or all of the product to be returned so that we can inspect the issue.
OUR FIRST REMEDY FOR A PRODUCTION ERROR IS GENERALLY A REPRINT OR CORRECTION
If PremiumCards confirms that we made a qualifying manufacturing error, our normal remedy will be, at our option:
- reprinting the affected product;
- replacing or correcting the affected portion of the order; or
- refunding the amount paid for the affected product.
Normal manufacturing variation within a disclosed tolerance is not considered a defect.
CANCELLATIONS MAY INCLUDE A 15% FEE
Orders that have not yet been processed may generally be canceled without a production charge.
After administrative processing, proof preparation, design work, material purchasing, custom tooling, or other work has begun, a cancellation may be subject to a 15% cancellation and processing fee, plus authorized custom costs already incurred.
Once production begins, custom orders generally cannot be canceled.
YOU ARE RESPONSIBLE FOR THE ARTWORK YOU PROVIDE
By submitting artwork, photographs, logos, trademarks, characters, names, or other material, you represent that you have the legal right or permission to have that material reproduced.
PremiumCards does not independently verify ownership or licensing of customer-supplied artwork.
You remain responsible for copyright, trademark, publicity-right, and other permissions associated with the content you provide.
CHARGEBACKS DO NOT AUTOMATICALLY CANCEL A VALID DEBT
We encourage you to contact PremiumCards first if there is a problem with an order so we can investigate it.
Nothing in these Terms prevents you from exercising a lawful credit-card or consumer billing-dispute right.
However, filing a chargeback does not automatically determine whether an underlying contractual balance is legally owed.
If a payment dispute occurs, PremiumCards may provide order records, proof approvals, acceptance records, customer communications, production documentation, and shipping information to the payment processor, bank, or card issuer.
If a valid contractual balance remains unpaid after the dispute process, PremiumCards may pursue lawful collection or legal remedies.
SHIPPING DELAYS CAN OCCUR
Shipping carriers operate independently from PremiumCards.
Carrier delays, weather, natural disasters, transportation interruptions, customs issues, and similar circumstances may affect delivery.
We will reasonably assist with legitimate lost or damaged shipment claims, but an estimated carrier delivery date is not automatically a guaranteed delivery date.
YOUR SHIPPING ADDRESS MUST BE CORRECT
You are responsible for entering a complete and accurate shipping address.
Additional charges may apply if an order must be redirected, reshipped, or reproduced because an incorrect or incomplete address was provided.
ABANDONED ORDERS
If we cannot complete an order because you have not supplied required artwork, approval, information, or instructions for 120 days, the order may be closed as inactive.
Any refund or credit may be reduced by authorized design work, materials, tooling, processing, and other costs already incurred, together with the applicable cancellation fee.
CALIFORNIA LAW GENERALLY GOVERNS
PremiumCards.net is operated by Mindpower Creative Media, LLC in California.
The complete Terms generally provide that California law governs the agreement and that eligible disputes may be handled in Los Angeles County, California.
However, mandatory consumer protections provided by your state that legally cannot be waived remain applicable.
THESE TERMS APPLY TO YOUR ORDER
By placing an order and checking the agreement box at checkout, you acknowledge that you have had an opportunity to review these Terms and agree to them.
The version of the Terms you accept when placing your order governs that order. We will not retroactively change the Terms of an existing order simply by updating this website.
